By accessing or using Viewbot.tv ("Service", "Platform", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use our Service. These Terms constitute a legally binding agreement between you and Viewbot.tv. Viewbot.tv provides digital marketing and audience engagement tools for streaming platforms including but not limited to Twitch and Kick. Our services include viewer boosting, chat engagement, follower growth, clip view enhancement, and poll participation tools. THE SERVICE IS PROVIDED FOR PROMOTIONAL, MARKETING, AND ENTERTAINMENT PURPOSES ONLY. We make no guarantees regarding the effectiveness, permanence, or specific results of our services. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

By using our Service, you acknowledge and agree that: a) PLATFORM TERMS: The use of our services may violate the terms of service of third-party platforms (including Twitch and Kick). You are solely responsible for understanding and accepting the risks associated with using our Service, including but not limited to potential account suspension or termination on these platforms. b) NO GUARANTEES: We do not guarantee any specific results, including but not limited to increased organic viewership, partnership status, monetization, or any other benefits on streaming platforms. c) ACCOUNT SECURITY: You are responsible for maintaining the confidentiality of your account credentials. We will never ask for your streaming platform passwords. Never share your passwords with anyone. d) ACCURATE INFORMATION: You agree to provide accurate, current, and complete information when creating an account and to update such information to keep it accurate, current, and complete. e) SOLE RESPONSIBILITY: You assume full responsibility for any consequences that may arise from using our Service, including any actions taken by third-party platforms against your accounts.

You agree NOT to use the Service to: a) Violate any applicable local, state, national, or international law or regulation; b) Engage in any activity that could damage, disable, overburden, or impair our servers or networks; c) Attempt to gain unauthorized access to any portion of the Service or any other systems or networks; d) Use the Service for any fraudulent, deceptive, or illegal purpose; e) Harass, abuse, threaten, or incite violence towards any individual or group; f) Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity; g) Interfere with or disrupt the integrity or performance of the Service; h) Attempt to reverse engineer, decompile, or disassemble any portion of the Service; i) Resell, redistribute, or commercially exploit the Service without our express written consent; j) Use the Service to artificially inflate metrics for fraudulent commercial purposes (such as deceiving advertisers or sponsors about your actual audience size). Violation of these prohibitions may result in immediate termination of your account without refund.

a) PRICING: All prices are displayed in USD unless otherwise specified. We reserve the right to change our pricing at any time. Price changes will not affect active subscriptions until renewal. b) BILLING: By subscribing to our Service, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions automatically renew unless cancelled before the renewal date. c) TAXES: You are responsible for all applicable taxes associated with your use of the Service. d) CHARGEBACKS: If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to immediately terminate your account and pursue all available legal remedies. Fraudulent chargebacks may be reported to relevant authorities. e) CURRENCY: All transactions are processed in USD. Currency conversion fees may apply depending on your payment method. f) FAILED PAYMENTS: If a payment fails, we may suspend your access to the Service until payment is successfully processed.

a) BY YOU: You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period. b) BY US: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to: - Breach of these Terms - Fraudulent, abusive, or illegal activity - Non-payment of fees - Upon request by law enforcement or government agencies - Extended periods of inactivity - Unexpected technical or security issues c) EFFECT OF TERMINATION: Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. d) NO REFUNDS ON TERMINATION: Unless otherwise required by applicable law, no refunds will be provided for any unused portion of the Service upon termination for cause.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT: - The Service will function uninterrupted, secure, or available at any particular time or location - Any errors or defects will be corrected - The Service is free of viruses or other harmful components - The results of using the Service will meet your requirements IN NO EVENT SHALL VIEWBOT.TV, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: - Your access to or use of or inability to access or use the Service - Any conduct or content of any third party on the Service - Any content obtained from the Service - Unauthorized access, use, or alteration of your transmissions or content - Suspension or termination of your accounts on third-party platforms - Any other matter relating to the Service OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless Viewbot.tv and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: a) Your violation of these Terms; b) Your use of the Service; c) Your violation of any rights of a third party, including any intellectual property or privacy rights; d) Any claim that your use of the Service caused damage to a third party; e) Any actions taken by third-party platforms against your accounts as a result of using our Service. This indemnification obligation will survive termination of these Terms and your use of the Service.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Viewbot.tv operates, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You agree that any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

a) ENTIRE AGREEMENT: These Terms constitute the entire agreement between you and Viewbot.tv regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations. b) SEVERABILITY: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. c) WAIVER: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Viewbot.tv's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. d) ASSIGNMENT: You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction. e) NOTICES: We may provide notices to you via email, regular mail, or postings on the Service. f) HEADINGS: The section headings in these Terms are for convenience only and have no legal or contractual effect. g) FORCE MAJEURE: We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
